The&nbsp;<a href=\"https:\/\/oeil.secure.europarl.europa.eu\/oeil\/popups\/ficheprocedure.do?lang=en&amp;reference=2020\/0374(COD)\" target=\"_blank\" rel=\"noreferrer noopener\">Digital Markets Act<\/a>&nbsp;(DMA) proposal blacklists certain practices used by large platforms acting as \u201cgatekeepers\u201d and enables the Commission to carry out market investigations and sanction non-compliant behaviours.<\/p>\n\n\n\n<p>The text approved by Parliament with 642 votes in favour, 8 against and 46 abstentions sets new obligations and prohibitions directly applicable to such platforms, with a view to ensuring fair and open markets.<\/p>\n\n\n\n<p>The proposed regulation will apply to the major companies providing so-called \u201ccore platform services\u201d most prone to unfair business practices. These include online intermediation services, social networks, search engines, operating systems, online advertising services, cloud computing, and video-sharing services, which meet the relevant criteria to be designated as \u201cgatekeepers\u201d. MEPs also included web browsers, virtual assistants and connected TV within the scope of the DMA.<\/p>\n\n\n\n<p><strong>Some key points<\/strong><\/p>\n\n\n\n<p>In the approved text, the European Parliament:<\/p>\n\n\n\n<ul><li>increases the quantitative thresholds that would mean a company is covered by the DMA to \u20ac8 billion in annual turnover in the European Economic Area (EEA) and a market capitalisation of \u20ac80 billion; companies would also need to provide a core platform service in at least three EU countries and have at least 45 million monthly end users, as well as more than 10,000 business users;<\/li><\/ul>\n\n\n\n<ul><li>includes additional requirements on the use of data for targeted or micro-targeted advertising and the interoperability of services, e.g. number-independent interpersonal communication services and social network services;<\/li><li>gives users the option to uninstall pre-installed software applications, such as apps, on a core platform service at any stage;<\/li><li>clarifies the role of national competition authorities, while keeping the enforcement of the DMA in the hands of the Commission;<\/li><li>says that the DMA should ensure whistleblowers are able to alert competent authorities to actual or potential infringements of this regulation and protect them from retaliation;<\/li><li>establishes that, if a gatekeeper does not comply with the rules, the Commission can impose fines of \u201cnot less than 4% and not exceeding 20%\u201d of its total worldwide turnover in the preceding financial year.<\/li><\/ul>\n\n\n\n<p><br>More details in this&nbsp;<a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20211118IPR17636\/digital-markets-act-ending-unfair-practices-of-big-online-platforms\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a>.<\/p>\n\n\n\n<p><strong>Next steps<\/strong><\/p>\n\n\n\n<p>The text approved today will be Parliament\u2019s mandate for negotiations with EU governments, planned to start under the French presidency of the Council in the first semester of 2022. The&nbsp;<a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20211210IPR19209\/digital-services-act-safer-online-space-for-users-stricter-rules-for-platforms\" target=\"_blank\" rel=\"noreferrer noopener\">Digital Services Act<\/a>&nbsp;(DSA) \u2013 a parallel proposal to regulate online platforms, dealing with, among other issues, illegal content and algorithms &#8211; is due to be put to the vote in plenary in January.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Parliament gave its green light to begin negotiations with member states on rules setting out what big online platforms will be allowed to do and not do in the EU.
