The Office of the Prime Minister did not deny that ex-Prime Minister Joseph Muscat received a precious\u00a0<\/span><span data-contrast=\"auto\">Bvlgari<\/span><span data-contrast=\"auto\">\u00a0watch valued at\u00a0<\/span><span data-contrast=\"auto\">\u20ac20,000<\/span><span data-contrast=\"auto\">\u00a0and three bottles of wine with a value of\u00a0<\/span><span data-contrast=\"auto\">\u20ac5,800<\/span><span data-contrast=\"auto\">\u00a0from\u00a0<\/span><span data-contrast=\"auto\">Yorgen<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">Fenech<\/span><span data-contrast=\"auto\">\u00a0in 2014.\u00a0 A press release<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">issued<\/span><span data-contrast=\"auto\">\u00a0by the Office of the Prime Minister said that the\u00a0<\/span><span data-contrast=\"auto\">ex-Prime Minister<\/span><span data-contrast=\"auto\">\u00a0\u201calways abided by the code and regulations relating to the gifts he received\u201d. However, a clearer explanation from the\u00a0<\/span><span data-contrast=\"auto\">ex-Prime Minister<\/span><span data-contrast=\"auto\">\u00a0should have been forthcoming.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In an article related to the Code of Ethics in\u00a0<\/span><span data-contrast=\"auto\">Cap 497 of the Public Administration Act<\/span><span data-contrast=\"auto\">\u00a0it is stated that \u201c<\/span><span data-contrast=\"auto\">No public employee or any member of his household shall accept gifts or<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">services such as might be deemed to create an obligation, real or imagined<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u2026<\/span><span data-contrast=\"auto\">\u00a0 A<\/span><span data-contrast=\"auto\">\u00a0gift can be interpreted as an inducement or a reward simply because of its<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">intrinsic value and therefore only token gifts may be accepted.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The problem with this code of ethics is that it places the responsibility of deciding whether action needs to be taken against ministers who accept official gifts on the Prime Minister. The Code of Ethics<\/span><span data-contrast=\"none\">,<\/span><span data-contrast=\"none\">\u00a0therefore,\u00a0<\/span><span data-contrast=\"none\">does not cater for the occasion when it is the Prime Minister himself\u00a0<\/span><span data-contrast=\"none\">who<\/span><span data-contrast=\"none\">\u00a0can be compromised by such gifts.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">In other European states, there are guidelines<\/span><span data-contrast=\"none\">\u00a0regarding the giving and receiving of gifts. One of the challenges is where to draw the line in this area. The receiving and giving of gifts\u00a0<\/span><span data-contrast=\"none\">presents a dilemma<\/span><span data-contrast=\"none\">\u00a0for government officials\u00a0<\/span><span data-contrast=\"none\">regarding whether a gift is meant as a bribe or is just a gift.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">One does not have to be a genius to realise that members of Cabinet receive gifts. But which gifts do they keep for themselves? This famous ministerial Code of Ethics must be strengthened and must make the gifts received by government officials (and their respective value) more public and transparent.
