Preliminary statistics regarding mediations that were brought before the Family Court in 2016 indicate that 42 percent ended in agreement.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>This was said by\u00a0Mark Attard Montalto,\u00a0the\u00a0Chairman\u00a0of the Mediation Centre in\u00a0a recent\u00a0interview with\u00a0<i>Voice of the Workers<\/i>.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>He said that this success is being reflected not only in the Family Court but also in the civil, commercial and industrial sectors.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>Mark Attard Montalto said that, instead of going to Court\u00a0one can resolve disagreements through alternative means. One can either resort to the process of mediation or arbitration.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>The difference is that in\u00a0the process of\u00a0arbitration\u00a0there is an arbitrator involved who can pass a decision and so has adjudicatory authority while in a mediation the mediator\u2019s job is to bring the parties together to come to a solution and an agreement.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>Dr Attard Montalto\u00a0said that the outcome of a mediation is as valid as a public contract. \u201cIf you have a formal mediation you will have an executive title, that is you will have a document that is as valid as a notarial contract\u201d, said the Chairman of the Mediation Centre.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>He added that the benefits of mediation are extensive and said that the public\u00a0is not yet aware or has not fully appreciated the advantages of mediation. Other than the fact that mediation in discussions are without prejudice and are confidential, the benefits extend to the fact that one can also interrupt any prescription period stated in the laws of Malta. This is the case when a mediation is brought to the Centre of Mediation.\u00a0<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>Another advantage\u00a0is tied to the expenses involved.\u00a0Dr.\u00a0Attard Montalto\u00a0explained that each party pays up to a maximum of\u00a0\u20ac120\u00a0and the mediator\u2019s fee.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>There is also the element of flexibility that gives the parties the right to come\u00a0up with creative\u00a0agreements.\u00a0If they do not come to an agreement in some areas they can still come to an agreement in other areas and leave\u00a0one or two\u00a0points pending.<span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>Thus, a big problem is reduced to a smaller one.
